Terms of Service

1. Acceptance of Terms

Welcome to SafeBeacon. The SafeBeacon mobile application and related services ("App" or "Service") are operated by SafeSignal Inc ("SafeBeacon," "we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement. If you are using the App on behalf of a minor with parental consent, you accept these Terms on their behalf.

3. Description of Service

SafeBeacon provides real-time location sharing and safety alert services for outdoor activities. Key features include:

• Activity Tracking: Share your real-time location with designated guardians during activities
• Stationary Alerts: Automatic notifications to guardians if you stop moving for an extended period
• SOS Alerts: Manual emergency notifications to your guardians
• Activity History: Record of your past activities and routes

4. Account Registration

To use the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

5. Subscription and Payments

SafeBeacon offers subscription-based access to premium features. By subscribing, you agree to:

• Pay the applicable subscription fees
• Automatic renewal of subscriptions unless cancelled
• Manage your subscription through the Apple App Store or Google Play Store

Subscription fees are billed through your app store account. Refunds are subject to the policies of Apple or Google, as applicable. To cancel your subscription, please follow the cancellation instructions in the App Store or Google Play Store.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any unlawful purpose or to track anyone without their consent
• Violate any applicable laws, regulations, or third-party rights
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to any part of the App
• Use the App to transmit harmful code or malware
• Impersonate any person or entity
• Use the App for any commercial purpose without our permission
• Reverse engineer, decompile, or disassemble the App

7. Guardian Consent

When you designate someone as a guardian and share your location with them, you represent that:

• You have provided accurate contact information for your guardians
• Your guardians have consented to receive notifications from SafeBeacon
• You have the right to share your location with these individuals

8. Location Services and GPS

The App requires access to your device's location services to function. You understand that:

• GPS accuracy varies based on device, environment, and conditions
• Location tracking requires cellular or WiFi connectivity
• Battery life may be affected during tracking sessions
• Location data may not be available in areas without cellular coverage

9. Intellectual Property

The App, including all content, features, and functionality, is owned by SafeSignal Inc and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, timely, secure, or error-free
• Location data will be accurate or available at all times
• Alerts will be delivered successfully in all circumstances
• The App will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFESIGNAL INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or property damage
• Loss of data or unauthorized access
• Failure of alerts or notifications to be delivered
• Inaccurate location information
• Any damages arising from your use of or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless SafeSignal Inc and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by deleting your account through the App settings or contacting us at help@safebeacon.com.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

16. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration or small claims court.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeSignal Inc regarding your use of the App.
